In 1871 he defended Thomas McGehan, accused of shooting one Tom Myers during a dispute in a bar. Vallandigham's defense was based on that Myers had shot himself to wield his gun when he was kneeling. To convince the jury, Vallandigham decided to demonstrate his theory. Unfortunately, he used a loaded gun by mistake and ended up shooting himself. With his death, Vallandigham demonstrated the theory of accidental shooting and got exonerate his client.
